Terms of Service

1. Eligibility

You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent. By creating an account, you represent that you meet these requirements and that the information you provide is accurate.

2. Account registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@pollcap.com if you suspect unauthorized access to your account.

Each subscription provides access for one organization. You may invite team members within your organization. You may not share your login credentials with individuals outside your organization or resell access to the Service.

3. Subscription and billing

Platform subscription

PollCap Platform is billed on a monthly subscription basis at the rate displayed at checkout (currently $799/month). All prices are in U.S. dollars. A 14-day free trial is available for new accounts. After the trial period, your payment method on file is charged automatically each billing cycle.

Payment processing

Payments are processed by Stripe. By providing your payment information, you authorize us to charge your payment method for all fees incurred. We do not store credit card numbers on our servers.

Cancellation

You may cancel your subscription at any time through your Stripe billing portal (accessible from Settings). Upon cancellation, you retain access to the Service through the end of your current billing period. After that, your account enters read-only mode. No refunds are provided for partial billing periods.

Campaign Intel add-ons

Campaign Intel services (opposition research, donor mapping, policy analysis) are offered by DFX Intelligence separately from the platform subscription. These services are scoped, quoted, and billed via invoice. Add-on services are governed by the individual statement of work provided at the time of engagement.

Price changes

We reserve the right to change subscription pricing with at least 30 days' written notice to the account holder via email. Price changes take effect at the start of the next billing cycle following the notice period.

4. Your data and intellectual property

You retain full ownership of all data you upload, create, or import into PollCap, including donor records, campaign profiles, event data, and outreach content. We do not claim any intellectual property rights over your content.

You grant us a limited, non-exclusive license to process your data solely for the purpose of operating the Service — including AI analysis, enrichment from public records, scoring, and report generation. This license terminates when you delete your data or close your account.

AI-generated outputs (intelligence briefs, scoring explanations, outreach drafts) are generated from your data and belong to you. We retain no rights over AI-generated content produced for your organization.

5. Public data sources

PollCap enriches your donor data using publicly available government records and research datasets, including data from the Federal Election Commission, U.S. Census Bureau, Bureau of Economic Analysis, Department of Housing and Urban Development, Zillow Research, and FollowTheMoney.org.

These are public records. Their inclusion in your PollCap account does not constitute a violation of any individual's privacy rights. You are responsible for using this data in compliance with all applicable federal, state, and local campaign finance laws.

6. Acceptable use

You agree not to:

• Use the Service for any purpose that violates federal, state, or local law, including campaign finance regulations.
• Attempt to access data belonging to other organizations or circumvent the Service's access controls.
• Use automated tools to scrape, crawl, or extract data from the Service beyond what the platform provides.
• Interfere with the Service's infrastructure, overload servers, or exploit vulnerabilities.
• Misrepresent AI-generated content as having been produced by a human without disclosure, where such disclosure is required by law.
• Use the Service to harass, intimidate, or threaten any individual.
• Resell, sublicense, or redistribute access to the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

7. Service availability and modifications

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, deploy updates, or modify features at any time. We will provide reasonable notice before making changes that materially reduce the functionality of features you rely on.

The daily intelligence pipeline runs automatically (currently at 2:00 AM ET). Real-time FEC data syncs run every 15 minutes. These schedules may be adjusted as the platform evolves.

8. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that AI-generated intelligence, donor scores, suggested ask amounts, or strategic recommendations will produce any specific fundraising outcome. PollCap is a decision-support tool — not a guarantee of results.

Public records data (FEC contributions, Census demographics, etc.) is provided as-is from government sources. We do not guarantee its accuracy, completeness, or timeliness.

9. Limitation of liability

To the maximum extent permitted by law, DFX Intelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:

• Loss of revenue, donors, or fundraising opportunities.
• Campaign outcomes or election results.
• Decisions made based on AI-generated recommendations.
• Data loss due to service interruption or account termination.
• Inaccuracies in public records data from third-party sources.

Our total aggregate liability for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DFX Intelligence, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

11. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Massachusetts. You consent to the personal jurisdiction of such courts.

12. Termination

Either party may terminate this agreement at any time. You may terminate by canceling your subscription and ceasing use of the Service. We may terminate your access if you breach these Terms, fail to pay subscription fees, or if we discontinue the Service.

Upon termination, your right to access the Service ceases. We will retain your data for 90 days in read-only mode, after which it may be permanently deleted. You may request an export of your data before deletion by contacting hello@pollcap.com.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via email to the account holder at least 30 days before taking effect. The “last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
